Terms and Conditions for all Purchase Orders & Quotations.

1. Terms: 1% 10 net 30 days subject to credit approval, otherwise payment is due with order and or prior to shipment. Unless otherwise noted, all credit charges will have a 3.5% processing fee. MJM Manufacturing, Inc., hereinafter referred as “MJM”, reserves the right to charge 1.5% per month service charge on all amounts remaining unpaid and past due. Return check will be $35.00 per check.

2. All blueprints or solid models created by MJM will become the property of MJM unless provided by the customer.

3. All material prices are based on current market conditions and are subject to change without notice.

4. All quoted prices will remain valid for 90 days from date of quotation.

5. MJM reserves the right to over ship orders by 5% unless otherwise agreed to.

6. All claims of non‐conformance parts (rejections) must be made within forty‐five days from receipt of shipment.

7. Non‐conforming parts must get prior approval to return parts by MJM issuing an authorized RMA number prior to returning parts. Parts proved to be defective may be replaced at the option of MJM. Customer’s repair costs will not be allowed unless authorized by MJM. We accept no claims for contingent damages.

8. Tooling, Silkscreens and or engineering fixture will remain the property of MJM, unless otherwise agreed too with the order. MJM has the right to dispose of any tooling, not used in more than two years.

9. Deliveries commitments dates are subject to strikes, fires, hurricanes, government regulations and other causes beyond our control, quoted deliveries dates are approximate only, and unless specifically stated to the contrary, we accept no responsibility for damage owing to delays in delivery.

10. MJM is not liable for any tax imposed by any present or future law of federal, state or any other government authority on the manufacture and/or sale of the articles covered by this quotation, shall be paid by customer. Customer’s material, dies, or tooling shall not be insured by MJM unless specifically requested by customer and made a part of the order at customer’s expense. If no special agreement is made, MJM assumes no responsibility for destruction or partial loss due to fire, or other casualty beyond MJM’s reasonable control.

11. Typographical or clerical errors are subject to correction.

12. After 3 years of inactivity, MJM reserves the right to dispose of tools and fixtures otherwise notified in writing by customer.

13. MJM’s acceptance of any purchase order is solely based upon the quote and conditions herein contained on the quote at the time it was quoted & submitted. Any changes must be agreed in written and must be approved by MJM Manufacturing, Inc.

14. In the event, MJM needs to engage an attorney at law to collect any sums due pursuant to an order based on its quote to produce custom made parts, then customer agrees to pay all reasonable costs of collection to include MJM’s attorney fees. Based on Florida laws.

15. All shipments are F.O.B MJM Manufacturing, Inc., located at 5205 NW 161 St Miami Lakes, FL 33014.

16. Taxes will be added to orders if Resale tax certificate is not presented.
